Throughout these Terms, “ANOVARD”, “we”, “us” and “our” refer to the seller identified above.
Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and services to you.
These Terms of Service apply to your use of the website and to purchases made through the ANOVARD online store.
Nothing in these Terms limits any mandatory consumer rights granted to you under Polish law or applicable European Union consumer protection law.
2. USE OF THE WEBSITE
You may use this website only for lawful purposes.
You must not use the website in any way that may damage, disable, overload or interfere with its operation, security or availability.
You must not attempt to obtain unauthorised access to any part of the website, customer account, system or network.
Information provided by you when placing an order or creating an account must be accurate, current and complete.
You are responsible for maintaining the confidentiality of your account credentials.
3. PRODUCTS
We make reasonable efforts to present our products accurately, including their descriptions, dimensions, colours, materials and photographs.
However, product colours and appearance may vary slightly depending on your screen, device settings, lighting conditions or production batch.
Product descriptions, specifications and availability may be updated from time to time.
We reserve the right to discontinue products or change product specifications where reasonable, provided that such changes do not affect orders already concluded unless permitted by law.
Any material product characteristic relevant to the purchase will be presented on the relevant product page before the order is placed.
4. PRICES
Prices displayed on the ANOVARD store are shown in the currency indicated on the website.
For sales to consumers, prices displayed at checkout will include applicable taxes where required by law.
Shipping charges, if applicable, will be shown before you complete your purchase.
The total amount payable will be displayed before you submit an order carrying an obligation to pay.
We may change prices at any time. Price changes do not affect orders already accepted by us.
Discounts and promotional offers may be subject to separate conditions.
5. ORDERS AND CONCLUSION OF CONTRACT
By submitting an order through the ANOVARD online store, you request to purchase the selected products under these Terms.
Before submitting the order, you will have the opportunity to review the products, quantities, delivery information and total price.
A sales contract is concluded when we confirm acceptance of your order by email or otherwise clearly confirm that your order has been accepted.
An automated acknowledgement that we have received your order does not necessarily constitute acceptance if it clearly states otherwise.
We may refuse or cancel an order where there is a legitimate reason, including:
- a product being unavailable;
- an obvious pricing or product information error;
- payment not being authorised;
- suspected fraud or unlawful activity;
- inability to deliver to the address provided.
If we cancel an order after receiving payment, the relevant payment will be refunded.
6. PAYMENT
Available payment methods will be displayed at checkout.
You agree to provide accurate and complete billing and payment information.
Payment may be processed by third-party payment providers. Your use of those payment methods may also be subject to the provider's terms and privacy policies.
We do not charge additional fees merely because a consumer uses a standard consumer debit or credit card where such charges are prohibited by applicable law.
7. SHIPPING AND DELIVERY
We currently deliver primarily within Poland. Additional destinations may be made available through the checkout.
Available delivery methods, delivery charges and estimated delivery times will be displayed at checkout where applicable.
Delivery options may include parcel lockers, pickup points and courier delivery.
Orders over 200 PLN qualify for free shipping within Poland where indicated on the website.
Delivery times are estimates unless a specific delivery date has expressly been agreed.
Where no different delivery period has been agreed, delivery will take place within the period required by applicable consumer law.
ANOVARD remains responsible for the goods during delivery until the goods are received by you or by a person designated by you, except where applicable law provides otherwise because the customer independently arranged a carrier not offered by us.

8. RIGHT OF WITHDRAWAL — 14 DAYS
If you are a consumer purchasing online, you generally have the right to withdraw from the sales contract within 14 days without giving a reason, subject to statutory exceptions.
For goods, the withdrawal period normally starts on the day you, or a person designated by you other than the carrier, receives the goods.
To exercise your right of withdrawal, you must inform us of your decision before the withdrawal period expires.
You may contact us through the Contact page or by email.
After notifying us of your withdrawal, you must return the goods without undue delay and, in general, no later than 14 days after informing us of your decision.
Unless we have agreed otherwise, the direct cost of returning goods when you simply change your mind is borne by the customer, provided you were informed of this obligation before purchase.
You may examine the product to the extent reasonably necessary to establish its nature, characteristics and functioning. You may be responsible for any reduction in value resulting from handling beyond what is reasonably necessary for that purpose.
When a valid withdrawal is exercised, we will refund payments in accordance with applicable law. We may withhold reimbursement until we receive the returned goods or you provide evidence that they have been sent back, whichever occurs first where permitted by law.

9. DEFECTIVE OR NON-CONFORMING PRODUCTS
Consumers have mandatory legal rights when purchased goods do not conform to the sales contract.
Under applicable Polish consumer law, the seller is responsible for a lack of conformity that becomes apparent within the statutory liability period, which is generally two years from delivery.
Depending on the circumstances and applicable law, you may be entitled to remedies including:
- repair;
- replacement;
- price reduction; or
- termination of the contract and refund where legally permitted.
A complaint concerning a non-conforming product will be handled without charging the consumer costs that the law requires the seller to bear, including relevant transport costs.
Nothing in any commercial warranty offered by ANOVARD limits your statutory consumer rights.

Please provide your order number and a description of the issue. Photographs may help us assess the issue more quickly but will not replace any mandatory consumer right.
10. RETURNS AND REFUNDS
Returns made under the statutory right of withdrawal and complaints relating to defective or non-conforming products are governed by different legal rules.
Please review our Returns & Refunds Policy before returning a product.
Refunds will normally be made using the same payment method used for the original purchase unless another method is expressly agreed and does not result in additional cost to you.
11. ORDER CANCELLATION
You may request cancellation of an order before fulfilment.
We will make reasonable efforts to process the request, but cancellation may no longer be possible once an order has entered the shipping process.
If the order has already been dispatched, consumers may still exercise their statutory right of withdrawal where applicable.
12. INTELLECTUAL PROPERTY
The ANOVARD name, logo, branding, website design, original graphics, photographs, text, product presentation and other original materials made available through the website are protected by applicable intellectual property laws.
Unless expressly permitted, you may not reproduce, distribute, modify, republish, commercially exploit or use ANOVARD intellectual property without prior written permission.
Third-party trademarks and intellectual property remain the property of their respective owners.
Shopify and its trademarks belong to Shopify and its respective affiliates.
13. REVIEWS, FEEDBACK AND USER CONTENT
If you voluntarily submit a product review, photograph, comment or other content to us, you confirm that you have the right to submit that content.
You must not submit unlawful, misleading, abusive, defamatory, infringing or malicious content.
Where legally permitted, by submitting content for publication you grant us a non-exclusive right to use that content for operating and promoting the ANOVARD store.
Nothing in this section allows us to alter consumer reviews in a misleading manner or misrepresent the views of customers.
14. THIRD-PARTY SERVICES AND LINKS
Our website may contain links to or integrations with third-party services, including payment processors, shipping providers, analytics providers and social media platforms.
Those third parties may operate under their own terms and privacy policies.
We are not responsible for independent third-party websites that are outside our control.
15. SHOPIFY
The ANOVARD online store is powered by Shopify.
Shopify provides technology that enables us to operate the online store, but purchases made from ANOVARD are transactions directly between you and ANOVARD.
Shopify is not the seller of ANOVARD products.
Shopify may process certain information in connection with operation of the e-commerce platform as described in the applicable privacy information.
16. PRIVACY AND PERSONAL DATA
We process personal data in accordance with applicable data protection law, including the GDPR where applicable.
Information about how we collect, use, store and share personal data is available in our Privacy Policy.
Shopify and other service providers may also process personal information where necessary to operate the online store, payments, delivery and related services.
17. PRODUCT SAFETY AND PROPER USE
ANOVARD products must be used in accordance with their intended purpose, instructions and any safety information supplied with the product.
Pet products do not replace appropriate supervision or responsible handling of animals.
For vehicle-related pet products, customers remain responsible for complying with applicable traffic, vehicle and animal-transport regulations.
Any safety restraint or travel accessory should be installed and used in accordance with the instructions supplied with the product.
Nothing in this section excludes liability that cannot legally be excluded.
18. LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, these Terms do not limit mandatory consumer rights concerning defective or non-conforming products.
To the extent permitted by law, we are not responsible for losses caused solely by misuse of a product, failure to follow reasonable instructions, unauthorised modification of a product or circumstances outside our reasonable control.
19. EVENTS OUTSIDE OUR CONTROL
We are not responsible for a failure or delay caused by circumstances outside our reasonable control, such as significant transport disruption, natural disasters, government restrictions, strikes or other extraordinary events.
This section does not affect mandatory rights you may have concerning delivery, refunds or cancellation.
20. PROHIBITED USES
You must not use the website:
- for unlawful purposes;
- to violate the rights of another person;
- to distribute malware or harmful code;
- to attempt unauthorised access to systems or accounts;
- to interfere with the security or functioning of the website;
- to scrape or systematically extract website content in violation of applicable law or our intellectual property rights;
- to submit fraudulent orders or false information.
We may restrict access where reasonably necessary to protect the website, customers or ANOVARD from unlawful activity.
21. CHANGES TO THESE TERMS
We may update these Terms from time to time, for example to reflect changes in law, our business or our services.
The current version will be available on this website together with its last updated date.
Changes will not retrospectively reduce rights arising from a purchase already concluded.
22. GOVERNING LAW AND CONSUMER RIGHTS
These Terms are governed by the laws of Poland, subject to any mandatory consumer protection rules that apply to you.
If you are a consumer resident in another country, this choice of law does not deprive you of mandatory protections that cannot be excluded under the laws applicable to you.
Nothing in these Terms prevents a consumer from using any competent court, consumer authority or alternative dispute resolution procedure available under applicable law.
23. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
